Terms of Service

These Terms of Service ("Terms") govern your access to and use of Legendary Feather (the "Service"), operated by Legendary Feather (Persona Física con Actividad Empresarial, registered in Mexico). By creating an account or using the Service you agree to these Terms.

Plain language summary. Be honest, don't break the law, don't try to break our systems. We provide best-effort AI translation but can't guarantee perfect accuracy. We can suspend abusive accounts. Disputes are handled under Mexican law, but EU and other consumers keep their non-waivable rights. Cancel anytime.

1. The Service

Legendary Feather provides real-time AI-assisted translation of speech and text between human languages. The Service includes a face-to-face translator, a customer dashboard, and customer support. Specific features depend on your subscription plan as described at /pricing.

2. Eligibility & Account

You must be at least 16 years old (or the age of legal capacity in your jurisdiction, whichever is higher) to create an account. You agree to provide accurate information and to keep your password confidential. You are responsible for activity under your account.

One person, one account. Sharing accounts is prohibited.

3. Plans, Pricing & Billing

Plans, prices, and included usage are described at /pricing. We may change pricing for new sign-ups at any time. Existing subscribers receive at least 30 days' notice before any price increase affects them.

Subscriptions renew automatically. You can cancel at any time from your dashboard. Refunds are governed by our Refund Policy.

If you exceed the included minutes on a usage-based plan, additional minutes are billed at the rate shown at the time of overage. Free and one-time-purchase plans hard-stop when minutes run out.

5. AI Output Disclaimer

Translation is performed by automated systems (including OpenAI Whisper, OpenAI Text-to-Speech, and DeepL). These systems can produce incorrect, incomplete, or misleading output, especially for ambiguous speech, low-quality audio, idioms, slang, technical jargon, or rare languages.

Do not rely on the Service for high-stakes communication where mistranslation could cause harm — for example legal proceedings, medical diagnoses, safety-critical instructions, or contractual negotiations — without human verification by a qualified interpreter.

6. Voice Recordings

Audio captured through your microphone is processed in real time and not retained beyond the duration needed to transcribe and translate it, except for transcripts which are saved to your conversation history.

Voice cloning (creating a synthetic voice that sounds like you) is currently disabled and deferred to V2. When re-enabled, it will require explicit consent, a recording of a verification phrase, and an audit log. Voice samples can be deleted on request and are watermarked for traceability.

7. Your Content

You retain all rights to the content you input into the Service (your spoken words, text, and translations of them). You grant us a limited, non-exclusive, revocable license to process that content solely to provide the Service. We do not use your content to train AI models.

8. Our Intellectual Property

The Service, including its software, designs, brand assets, and the "Legendary Feather" name and logo, is owned by Legendary Feather and protected by copyright, trademark, and other laws. You receive a limited, non-transferable, revocable license to use the Service for its intended purpose.

9. Privacy

Our collection and use of your data is governed by the Privacy Policy, which is incorporated into these Terms by reference.

10. Service Availability & Beta Features

We aim for high availability but do not guarantee uninterrupted service. Maintenance, third-party API outages, and bugs can cause temporary unavailability. See the Refund Policy for service-credit terms during outages.

Features marked as "beta", "experimental", or "early access" are provided as-is and may be modified or removed without notice.

11. Termination

You can delete your account at any time from Settings → Danger Zone or by emailing legal@legendaryfeather.com. Deletion is final after a 7-day grace period during which you can recover the account by signing in.

We may suspend or terminate your access if you breach these Terms, if required by law, or if continued service would expose us to legal liability. We will give you reasonable notice when feasible.

12. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

This section does not limit any non-waivable consumer rights you may have under your local law (e.g., Mexican PROFECO protections, EU consumer rights, UK consumer rights).

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Legendary Feather, its employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the Service.

Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow these limitations. In such cases, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold Legendary Feather harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service. This does not apply to consumers acting outside their trade or profession in jurisdictions that prohibit consumer indemnification.

15. Governing Law & Disputes

These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the competent courts of Mexico, except that consumers may bring claims in their country of residence where required by local consumer-protection law.

Before filing any formal claim, you agree to contact us at legal@legendaryfeather.com and attempt to resolve the dispute in good faith for at least 30 days.

16. Changes to These Terms

We may update these Terms from time to time. Material changes are announced by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, you can cancel your account.
